Patient Communications - Are You HIPAA Compliant?

Overview

Your pharmacy may have email addresses and cell phone numbers for your customers and patients as their preferred communication forms, but is this HIPAA compliant? Could you also send out texts and emails about your pharmacy and new services? 

For social media, emails, and texting, it is even more difficult to determine if communications are HIPAA compliant. The CAN-SPAM Act and the TCPA (Telephone Consumer Protection Act) also play a role for emails and phone/text messages. An additional consideration are voice assistants (e.g. Siri, Alexa) and whether they are “listening” when you are talking to patients or when working from home.

This webinar reviews HIPAA and HITECH requirements, defines what is considered PHI (Protected Health Information), discusses communications with patients in their preferred format (including the requirements), and explores the considerations when marketing with customer phone numbers and email addresses.

    Denise Frank, RPh, FACA, FAPC

    Denise Frank has more than 35 years of experience as a pharmacist. She is the owner of Frank Consulting, LLC; co-founder and Executive Director for the National Coalition for Drug Quality & Security (NCDQS); and a Senior Associate with Gates Healthcare Associates. She is a former member of the Minnesota Board of Pharmacy, and previously served as a surveyor and then the Accreditation and Inspection Services Manager for the National Association of Boards of Pharmacy (NABP). Prior to this, she was an independent pharmacy owner, worked for a health-system, and was a pharmacy manager and district manager for a pharmacy chain.

    Denise Frank is also a preceptor for the University of Minnesota College of Pharmacy. Her consulting is in the areas of pharmacy practice, pharmacy and technician training, compounding, USP 795/797/800/825, pharmacy, wholesale distributor and supply chain inspections, accreditations, and operational and regulatory compliance.

    COMPLETION REQUIREMENTS

    1. Attend the live webinar in full (login and logout times will be recorded).
    2. Complete a learning assessment (minimum 80% passing grade, two attempts permitted) within 14 days.
    3. Submit a completed live event evaluation form online within 14 days.

    When the aforementioned steps have been completed and approved:

    • Pharmacists and Pharmacy Technicians registered in the United States will obtain a statement of completed credits on their NABP e-Profile within 60 days.
    • Pharmacists and Pharmacy Technicians registered elsewhere will receive an automated email from LP3 Network advising that they can download a statement of participation.
